These Terms of Service ("Terms") govern your use of the Accelerate Capital website and pre-qualification funnel ("Services"). By submitting a pre-qualification request, accessing our website, or otherwise engaging with Accelerate Capital, you agree to be bound by these Terms.

1. About Our Services

Accelerate Capital is a financing brokerage that helps real estate investors seeking business or investment-purpose financing shop their deal to a network of lending partners, including DSCR, bridge, fix-and-flip, ground-up construction, cash-out refinance, and portfolio programs. Accelerate Capital is not a direct lender. We do not make any lending decision, set any rate or term, fund any loan, or guarantee funding. All lending decisions, underwriting, rates, terms, and approvals are made solely by the applicable lending partner.

2. No Guarantee of Matching or Funding

Submitting a pre-qualification request does not guarantee that you will be matched with a lending partner, that any lending partner will contact you, or that any lending partner will approve, price, or fund your financing request. Any timeline, speed, or "matched" language on our website or in our marketing describes how quickly we may connect you with a lending partner, not a commitment by any lending partner to fund your deal.

3. How We Are Compensated

There is no upfront cost to you to submit a pre-qualification request or to have your deal shopped. Where a financing transaction closes, Accelerate Capital is typically compensated by the funding lender, and any such compensation is disclosed to you before you commit to a transaction. Any fees, rates, points, or costs associated with an actual financing transaction are set solely by the lending partner and disclosed to you directly by that lending partner.

4. Business and Investment-Purpose Use Only

Our Services are intended solely for business or investment-purpose financing on non-owner-occupied investment property (fix and flip, bridge, DSCR rental, ground-up construction, portfolio, and cash-out refinance). Our Services are not available for, and may not be used to seek, financing for the purchase or refinance of a primary residence.

5. Data and Privacy

Information you submit through our funnel or website is collected, stored, and processed in accordance with our Privacy Policy. By submitting the form, you consent to be contacted by Accelerate Capital and the lending partner(s) matched to you, as described in the consent language you agree to at submission and in our Privacy Policy. You may opt out at any time by replying STOP to any text message or following the unsubscribe instructions in our emails.

6. Limitation of Liability

To the maximum extent permitted by law, Accelerate Capital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our Services, including any decision made or action taken by a lending partner we connect you with. Our total liability for any claim arising under these Terms shall not exceed one hundred dollars ($100).

7. Intellectual Property

All content on this website, including text, graphics, logos, and methodology, is the property of Accelerate Capital and is protected by intellectual property laws. You may not reproduce, distribute, or use our materials without prior written permission.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Accelerate Capital is registered. Any disputes arising under these Terms shall first be addressed through good-faith negotiation, and if unresolved, through binding arbitration in that jurisdiction.

9. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Accelerate Capital regarding the Services and supersede any prior representations, advertisements, or communications, whether written or oral.

10. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Services after changes constitutes acceptance of the updated Terms.
